About the Role:
Graham has an opportunity for a permanent full-time Commercial Manager, initially supporting our 85th Street project, under the US infrastructure group. The position is based in Bellevue WA and reports to the Operations Director. As a Commercial Manager at Graham, you will:
- Evaluate and report on commercial matters related to project pursuits
- Engage with in-house and external legal resources
- Provide advice to bid teams regarding commercial risk management strategies, including risk mitigation and pricing options
- Work closely with the bid team, senior Graham management and legal resources to understand prime contract rights and obligations and develop appropriate negotiation strategies to maximize opportunity and minimize risk to Graham
- Negotiate Prime Contract terms and conditions with Owner representatives
- Develop and negotiate ancillary contract documents including but not limited to NDA’s, MOU’s, teaming agreements, subcontracts and joint venture agreements with partners, subcontracts, consultants, and suppliers
- Manage Subcontractor Administration, confirming all preparations and processes are strictly adhere to
- Oversee design process, working with client and internal stakeholders to ensure expectations are met
- Establish a commercial management plan for the on-site monitoring and reporting on commercial matters
- Work with the Owner’s commercial resources to identify commercial issues early and structure timely and acceptable resolutions
- Oversee compliance with all applicable laws, regulations, statutes, and contractual requirements
- Advise the project management team on the contractual significance of proposed actions
- Act as the subject matter expert on contracts documents and engaging with legal resources as required to ensure Graham is fully aware of its rights, obligations, risks, and opportunities
- Review and negotiate any changes to contract documents in accordance with commercial best practices and Graham’s authority matrix
- Prepare review all contractually significant communications and notices
- Manage all project records, communications, and documentation in accordance with contractual requirements and commercial best practices
- Provide advice on all commercial issues to minimize disputes and claims and ensure that Graham is well positioned if a formal dispute arises
- Provide direct support for all mediation, arbitration, and litigation
- Ensure that all projects are commercially closed, and all contractual documents is collected and archive in accordance with legal, accounting, and contractual requirements
Qualifications & Experience:
- Degree in Construction Management, Engineering, Quantity Surveying, Business, or equivalent experience in related field and 8-10 years of experience in direct contract management
- Advanced knowledge of commercial construction contract administration and the principles of purchasing, finance, and estimating
- Preferred experience with WSDOT
- Thorough understanding of contract law and detailed experience working with various contract types and forms
- Experience working within a P3 / Design-Build environment or EPCM environment
- Ability to effectively influence and negotiate
- Ability to draft and interpret legal language

- Salary: 160k-170k
