Commercial Manager
Description
  • (Internal Title: Claims III)
    • Develop and maintain strong collaborative working relationships, developing mutual trust and understanding
    • Support the commercial management of the Rail Adjacent works and Advance tunnel works, supporting the timely payment of the works, progress reporting, variations, delays and contract management
    • Support on definition of Allowable Costs, assessment of incentive payments, verifying eligible cost
    • Supports teams understanding of the Contract
    • Liaison with the Independent Certifier on Payment Certification
    • Support to Control, manage, and report contractual obligations including contract administration involving Early Warnings and Change Control
    • Advise on submitted claims and early warnings, validity of entitlement, quantification, and proposed mitigation, including assessing and resolving the claim’s merits 
    • Attending progress meetings, recording and reporting regular upstream Client meetings and downstream meetings with Project Team and when necessary, its Supply Chain
    • Budget planning, forecasting and cost management
    • Contributes into the risk and opportunity reporting
    • Participates in the evaluation of claims for delay and additional costs
    • Support aspects of contract administration including payment certification, reconciliations, cost reporting, change management and reporting on progress
    • Provide substantial input to performance measurement systems, Key Result Areas/ KPIs, implement long term improvement processes and monitor the results
    • Draft and review contractual correspondence on all claim-related matters 
    • Handle negotiations of small to mid-size claims to establish acceptable pricing terms and conditions for contracts, contract changes, and claims with contractors and other service providers, as well as coordinate support from other key stakeholders  
    • Interpret contracts and ensure compliance with contract terms and conditions and the scope of work 
    • Liaise with stakeholders on team performance and overall deliverable issues 
    • Training and development, mentoring of junior staff
    • Identify commercial risks and implement mitigation strategies and contingency plans through the claims management process 
    • Complete any tasks assigned by manager or higher in an efficient and timely manner

Requirements
  • Experience: 
    • Minimum of 3 years of experience in Claims   
    • Minimum of 3 years of experience in Contract Administration 
    • Relevant experience in infrastructure or rail transit projects with renowned construction or consulting company(s)
  • Education:  
    • Bachelor’s degree in Engineering, Business Management, Quantity Surveying, or relevant field of construction 
  • Licenses OR Certifications:  
    • Holding recognized certifications in specified fields including Engineering, Contracts Management, Certified Construction Claims Specialist (CCCS), Certified Construction Delay Analyst (CCDA), Certified Construction Contract Administrator (CCCA); Project Management certification - PMI (Project Management Institute), or equivalent  
  • Skills and Competencies: 
    • In-depth understanding of prevailing Commercial Management methods  
    • Demonstrated experience and understanding of schedule delay analysis in claims  
    • Advanced skills in Microsoft Office 
    • Proficient in Project Management software 
    • Thorough knowledge of contract language, claim process, and legal requirements of construction contracts across a variety of contract types 
    • Proven capability to review major complex bespoke contracts in the building and civil engineering sectors to identify and communicate risks and mitigation strategies 
    • Effective ability to negotiate terms under contracts  
    • Tailor information for different audiences through presentations, reports, and other means   
    • Adept in reviewing schedules and understanding delay analysis of claims 
    • Experienced in quantity surveying  
    • Capability to build relationships 
    • Ability to detect, capitalize, and be sensitive to others' strengths    
    • Strong supervision, delegation, and capacity development  
    • Extensive experience in effectively leading mid-sized multi-discipline commercial teams  
    • Fundamental skills to perceive and ameliorate conflict and tension 
    • Ability to arrange priorities and escalate competing risks to meet deadlines with minimum input from leadership   
    • Keen eye for detail and adept problem-solving abilities    
    • Must have demonstrated experience relaying and receiving information (written and verbal)  
    • Expert ability to work collaboratively and independently in a structured, disciplined, technology-driven environment
